My 84 yr old mom sold a mobile home park that belonged to her and my dad (her deceased husband.) The selling price was 675,000.00 but the buyer paid 525,000.00 at closing and held back 150,000.00 that was to be paid to my mom in monthly payments at 5% interest for 10 or 15 years. He said he had to hold this money back in case he needed to make repairs to the sewer system. The park has well water and it's own sewer system. Mom agreed to a one year warranty starting on the day of the closing which was October 31, 2007. The buyer has been making monthly payments to her for 11 months now at 1200.00 mo. She received a letter from their attorney today (10/17/2008) that said they have estimates for sewer repairs, water system repairs, engineer costds, well costs and so on. They say it has used up all the money owed to her and want an attorney to contact them because of the November 1 nearing. They sent this letter to our family attorney and he sent the copy to us. I think we need a good real estate attorney. Can you give us any advice.
